Police pounced on Miguna Miguna, and re-arrested him immediately he was released from the cells. Information reaching our desk from his close confidants, also claim that the youths who had gone to seek his release were also arrested and put behind bars awaiting charges to be preferred on them by state organs, but when the police were asked to tell or inform the media on what specific charges and the reasons why they were arresting the youths for, no answers were forthcoming.
Miguna Miguna was released by orders from Justice Wakiaga, and ordered to pay cash bail of 50,000 and then be brought back on Monday to court for mention or for police to prefer charges on him so that his case can be preferably be properly in court.
The self declared NRM General faces charges of unlawfully participating in a gathering meant to jeopardize security and his charges might read exactly as that of Ruaraka Mp TJ Kajwang.
The application to have him released was filed by lawyer John Khaminwa, assisted by Hon. Kaluma and Edwin Sifuna – they convinced Justice Wakiaga that police were out to harm and subject Mr. Miguna Miguan to mental anguish and torture if they continue to hold him till monday.
The orders were to be served on the Inspector General of the Police Mr. Joseph Boinnet, CID Director and the Director of Public Prosecutions and were to be be implemented or acted upon immediately.
The burly City and International Barrister has dared the state agents to arrest him over what the Government security agents termed an illegal “oath” taking administered by him and the Mp of Ruaraka Mr. TJ Kajwang who was also arrested but released on bond 12 hours later and is expected to appear in court.
He is facing charges of being present and consenting, and administering of an illegal oath to commit a serious capital offense, termed as treason, contrary to section 59(a) of the penal code of the 2010 constitution of Kenya.
