Petition Challenging Ojaamong’s Victory Dismissed as Petitioner Directed to Pay Ksh. 12 Million Cost

Justice Waweru said Petitioner Failed to Prove his Allegations

  • The petitioner failed to prove his case and suffered a major setback after the court directed him to pay a cost of Sh12 million.
  • The cost slapped on the petitioner will be shared among the County Returning Officer, Ojaamong and the Independent Electoral and Boundaries Commission.

A Busia Court on Monday 12 dismissed the election petition challenging the victory of Busia governor Sospeter Ojaamong. According to Justice Kiarie Waweru Peter Odima Khasamule failed to prove his case and suffered a major setback after the court directed him to pay a cost of Sh12 million.

Apparently, Odima was the chief campaigner of former Funyula MP Paul Otuoma and gubernatorial aspirant, who finished second in the gubernatorial race after the current Governor Ojaamong. According to Otuoma, Ojaamong never won rightfully since there elections were not free unfair whereby his victory was rigged, thereby wanting the court to annul his win.

The cost slapped on the petitioner will be shared among the County Returning Officer, Ojaamong and the Independent Electoral and Boundaries Commission. In a notice by the Deputy Registrar, the court had earlier ordered that all proceeding for the day will be delayed to allow for the delivery of the judgement. “Due to the interest the case generates in the county and subject to the space in court, all other sittings shall start at 10.30am to allow for delivery of the same without interference to the other court processes by members of the public who are interested in the outcome,” part of the notice read.

This comes barely three days after a Machakos court dismissed a petition against the Machakos county Governor Alfred Mutua. A case filed by former Kathiani MP and Mutua’s close opponent Wavinya Ndeti wanted the governor’s victory nullified saying the polls lacked credibility and transparency. However in his ruling Justice Muchelule dismissed the case on grounds of lacking merit and slapping Ndeti with a cost of ksh. 10 Million.
