Rasanga wins battle to be on ballot

The High Court on Friday quashed a decision by the Political Parties Dispute Tribunal to cancel the nomination of Governor Cornel Rasanga as the ODM gubernatorial candidate for Siaya County.

Mr Justice Enoch Chacha Mwita set aside the ruling by tribunal which had barred ODM from presenting Mr Rasanga’s name to the Independent Electoral Boundaries Commission (IEBC).

The Judge directed the party to submit the governor’s name to the electoral agency for him to be listed as a candidate for the August 8 general elections.

Justice Mwita said the tribunal erred in law and fact by failing to establish whether two petitioners, Jeckonia Okungu Ogutu and Mr Julius Ooko Okayo were members of the ODM.

The Judge also said the tribunal failed to establish that the two petitioners had failed to avail a full list of the members of ODM from the party headquarters.

“The petitioners made generalised allegations of voter bribery and other electoral malpractices,” he ruled.
