Githu Muigai steps in to end row over varsity council

Attorney-General Githu Muigai has stepped in to resolve a row between Education Cabinet Secretary Fred Matiang’i and the University of Nairobi over the appointment of the institution’s council members.

The decision is a blow to Dr Matiang’i, who had insisted that new council members are the only ones authorised to transact business at the institution and not the team that was in office until March.

In his advisory opinion to the parties involved, Prof Muigai said the council — whose members include Dr Sanjay Advani, Ms Pascalia Koske and Dr Lucy Kiyiapi and were appointed on July 31, 2013 — should continue to serve.

LEGAL BASIS

Ms Koske was the acting council chairperson after replacing Dr Idle Farah, whose term came to an end last year.

The advisory opinion, dated June 28, says the power regarding the removal of the council must be in accordance with the law.

On Friday, the university declined to comment on the matter.
