Court orders arrest of Governor Kinuthia over contempt

The labour court has ordered the arrest of Nakuru Governor Kinuthia Mbugua for failing to comply with its orders.

The order is also directed at the county secretary for failing to pay the salaries of six former employees as had been directed by the Employment and Labour Relations Court (ELRC) last October.

Lady Justice Monica Mbaru of the ELRC said they should appear in court next week to explain why they should not be jailed for violating an order of the court.

They are supposed to be arrested by the officer commanding police station Nakuru.

Lawyer for the employees said the officials should urgently be brought to court to answer to the contempt of court accusation leveled against them.

According to the lawyer, the court had made a finding that the employees had been unlawfully suspended and they should be paid their dues. 

It was therefore irregular for the governor and the county secretary to continue holding onto their wages.

The labour court had directed the governor and the Secretary to compute and pay the wages accrued while the employees were suspended but the order has not been complied with, hence the present application.

The case will be heard on June 13.
